Ordre public et démocratie - épisode 13 : Ce brouillard qui tarde toujours à se lever

Episode 12 pointed out how human rights can be restricted under the European Convention on Human Rights subject to a legal provision and a limiting condition provided for by the Convention.

This episode 13 explains the condition that the restriction has moreover to be necessary in a democratic society and proportionate to comply with the Convention.

In “Ordre public et démocratie” L. Cornelis makes the point that the legal system is largely responsible for the current challenges our society is facing as a result of human, economic and financial activities.

Law and the administration of justice however can according to him become driving and innovative forces able to control the major challenges we face if they are restructured in the way proposed and detailed in “Orde public et démocratie”.
